Resumo(s): | Com o estudo desenvolvido na presente dissertação de mestrado fizemos uma
análise ao instituto jurídico da menoridade e as respetivas formas de suprimento.
Analisamos a capacidade negocial do menor, porquanto, genericamente, a
incapacidade do menor surge com o seu nascimento e cessa quando perfaz dezoito anos
de idade e, procedemos à análise do ordenamento jurídico em relação aos atos que
podem ser praticados pelo menor.
Tratamos da questão da autonomia do menor no ordenamento jurídico português
e analisamos também a sua evolução ao longo dos anos, em correlação direta com a
evolução das responsabilidades parentais.
Analisamos ainda a afirmação da progressiva autonomia do menor que se operou
ao longo dos anos, deixando de ser considerado como um mero “peão” obediente,
passando a ter objetivos de vida próprios, guiando-se não só pelas indicações legítimas
de quem o educa, mas também pela sua intrínseca individualidade, e pela maturidade
que nele se vai intensificando e que cada vez mais lhe é reconhecida.
Procedemos a uma análise e recolha jurisprudencial relativamente ao conceito de
“questões de particular importância”, uma vez que o mesmo não se encontra definido na
nossa legislação, cabendo à doutrina e à jurisprudência o seu preenchimento.
Seguidamente analisamos os instrumentos que regulam e protegem os direitos
das crianças e adolescentes. Na senda internacional analisamos, entre outros, a
Declaração dos Direitos das Crianças e a Convenção sobre os Direitos das Crianças. No
âmbito do direito interno, procedemos à análise de algumas normas da Constituição da
República Portuguesa, o nosso Código Civil, o Código Penal, o Regime do Processo
Tutelar Cível, a Lei de Proteção de Crianças e Jovens em Perigo, a Lei Tutelar
Educativa e fizemos ainda referência a alguns diplomas avulsos que se relacionam com
a autonomia dos menores.
Por fim tratamos de alguns casos práticos, que consideramos serem de maior
relevância jurídica e social, sobre o consentimento do menor para a prática de atos
médicos e para o aborto. With the study developed in this dissertation we have analysed the legal institution of minority and the respective forms of provision. We have analysed the minor’s negotiating ability, since it starts with his birth and ends when he reaches eighteen years old, and we have proceed to the analysis of the legal system in relation to the acts which can be practiced by the minor. We have treated the minor’s autonomy issue in the Portuguese legal system and we have also analysed its evolution over the years, in direct correlation with the evolution of parental responsibilities. We have also analysed the progressive affirmation of the minor’s autonomy operated over the years, no longer considered as a mere obedient "pawn", having their own life goals, guiding himself not only by the legitimate indications of those who educates him, but also by his intrinsic individuality, and maturity that will increasingly be intensified and recognized. We have carried out an analysis and jurisprudential selection for the concept "issues of particular importance", since it is not defined in our legislation, the doctrine and jurisprudence should proceed to its fill. Then we have analysed the instruments that regulate and protect the children and adolescents’ rights. In the international path we have analysed, among others, the Declaration of the Rights of the Child and the Convention on the Rights of the Child. Under the national law, we have proceed to the analysis of some norms of the Portuguese Constitution, our Civil Code, the Penal Code, the Board of Civil Guardianship Process, the Law of Protection of Children and Young People in Danger, Law Educational Guardianship and we have also done some reference to some loose diplomas relating to minors’ autonomy. Finally we dealt with some practical cases, we considered to be of greater legal and social relevance on the minor's consent to the practice of medical acts and abortion. |
