Land and human rights in Africa

Abstract

This internship has been organized and conducted by the department of the Special Programme on Africa (SPA) at the Amnesty International Dutch Section, under the theme “Land and Human Rights in Africa.” The entire internship programme lasted from July 2011 to May 2012, the academic aim of which is to conclude my Master’s in International Relations at the University of Minho. Various activities were carried out during this internship period of which various methods were used to undertake these activities. Among other major activities, I organized an expert meeting for land and human rights in Africa. This meeting brought together experts on the theme to determine the relevance, need and content of a handbook on land for human rights activists in Africa. This handbook is currently been written by experts on this topic and will be a guiding tool for human rights activists to defend the land rights of people. Apart from organising the expert meeting I also attended high profile meetings and conferences on behalf of SPA on land and human rights issues. I conducted a field study in Sierra Leone on commercial land acquisition, a key issue on the theme of this internship. This study carried out in three chiefdoms was meant to identify some of the impacts of commercial land acquisition by foreign investors on the livelihoods of the local communities. This study also identified ways for SPA coalition partners in the field to effectively incorporate a focus on land acquisition into their future programme activities. On the theme of this internship I argued why land rights ought to be human rights from an African perspective, while recognising that land rights are not inscribed in international human rights instruments and legal frameworks. Land rights are very crucial for Africa as land is the major source of livelihood for many. Land is also inextricably linked to other human rights such as the right to housing, food, adequate standard of living etc. This report also explored the major arguments used by human rights activists, NGOs, Civil Society Organisations and other groups in attempting to place land under human rights framework in the African context. Adequate actions need to be taken to place land rights under the human rights framework. This include using legal standards to defend the land rights of people, strengthening the capacities of NGOs and local organisations in order to campaign for the realisation of a secured land rights and in turn holding governments more accountable to the people.

Este estágio foi organizado e conduzido pelo departamento do Programa Especial sobre a África (SPA) na Secção holandesa da Amnistia Internacional. O programa de estágio decorreu entre Julho de 2011 e Maio de 2012, com o objetivo académico de concluir o meu Mestrado em Relações Internacionais na Universidade do Minho. Foram realizadas várias actividades durante o período de estágio, com recurso à aplicação de diversas técnicas mais próximas do método qualitativo. Entre as actividades mais relevantes, organizei uma reunião de peritos sobre a terra e os direitos humanos em África. Este encontro reuniu especialistas neste domínio, com o fim de determinar a relevância, necessidade e conteúdo de um manual sobre terra e seus direitos, para ativistas de direitos humanos em África. O manual está atualmente a ser elaborado por peritas e servirá como ferramenta de orientação para os ativistas de direitos humanos na defesa dos direitos dos povos africanos sobre as terras. Para além da organização da reunião de peritos, também representei a SPA em reuniões e conferências de alto nível centradas nas questões de terra e direitos humanos. Conduzi um estudo de campo na Serra Leoa, sobre a aquisição de terrenos comerciais, uma questão fundamental no domínio deste estágio. O estudo, realizado em três tribos, visou identificar alguns dos impactos da aquisição de terras por investidores estrangeiros sobre os meios de subsistência das comunidades locais. O estudo também identificou formas de os parceiros de aliança local da SPA efectivamente incorporarem o tema da aquisição das terras nas suas futuras atividades programadas. No que concerne ao tema deste estágio, argumentei porque o direito sobre a terra deveria ser entendido como um direito humano na perspectiva africana, embora reconhecendo que o direito sobre a terra não está inscrito em instrumentos internacionais de direitos humanos e seus quadros jurídicos. O direito sobre a terra é crucial para a África, visto que a terra é a principal fonte de subsistência para muitas pessoas. A terra está também intrinsecamente ligada a outros direitos humanos, como o direito ao alojamento, à alimentação, ao padrão de vida adequado, entre outros. Este relatório também identificou os principais argumentos usados por ativistas de direitos humanos, ONGs, Organizações da Sociedade Civil e outros grupos, na tentativa de colocar o direito sobre a terra no âmbito do quadro dos direitos humanos no contexto africano. Devem ser tomadas medidas adequadas para colocar o direito sobre a terra no âmbito dos direitos humanos. É essencial o uso de normas legais para defender os direitos territoriais dos povos, bem como reforçar as capacidades das ONGs e das organizações locais, a fim de advogar a realização do direito dos povos africanos sobre a terra e, por outro lado, responsabilizar os governos perante os povos.
