Resumo(s): | A presente dissertação propõe uma indagação sobre a Linguagem Jurídica num plano que permita
a compreensão mais completa possível desta questão. Assim, ela divide-se em três grandes
capítulos cuja ordenação visa permitir ao leitor uma construção lógica, sistemática e sequencial
sobre o tema em causa.
Primeiramente, dedicamo-nos às eventuais causas do problema: uma análise exclusivamente
linguística, com base nos conhecimentos adquiridos nas Unidades Extracurriculares de Introdução
ao Estudo da Linguagem e Análise do Discurso. Com esta formação, debruçamo-nos sobre
doutrina das Ciências da Linguagem em busca de possíveis explicações para a caracterização tão
própria da linguagem no mundo jurídico, visando não só provar cientificamente a existência de
uma variante linguística jurídica, mas também tentar encontrar os motivos que levam a que esta
se desenvolva em primeiro lugar.
O segundo capítulo versa, por sua vez, sobre a tutela jurídica deste problema, desde os
instrumentos internacionais, passando pela lei orgânica, e culminando em diplomas específicos.
Conforme a pesquisa demonstrará, a complexidade da linguagem jurídica é já há algum tempo
conhecida e tutelada pelo legislador em múltiplos preceitos legais.
Porém, o problema persiste, e a mera previsão legal não tem sido suficiente para o solucionar; o
que nos leva ao terceiro capítulo. Aqui, exploramos não só as medidas e projetos mais concretos
que se encontram atualmente em curso para fomentar a simplificação da linguagem em múltiplos
órgãos do Direito, mas propomos também algumas soluções que não foram exploradas e que, a
nosso ver, poderiam trazer resultados benéficos. The following dissertation proposes an enquiry about Legal Language in a plan which allows the best possible comprehension of this question. Therefore, it splits in three big chapters whose order intends to allow the reader a logical, systematic and sequential constuction about the topic in question. First and foremost, we dedicate ourselves to the possible causes of this problema: an exclusively linguistic analysis, based upon the knowledges acquired in the Extracurricular Units of Introduction to Linguistic’s Study and Discourse Analysis. With this training, we paid attention to doctrine on Linguistic Sciences searching for possible explanations for the specific characterization of language in the legal world, seeking not only to prove scientifically the existence of a legal linguistic variant, but also to try and find the reasons which lead to its development in the first place. The second chapter treats, in turn, the legal protection of this problema, from international instruments, going through the organic law, and culminating in specific legal previsions. As our research will demonstrate, the complexity of legal language has been known and envisaged by the legislator in various legal documents. However, the problema persists, and sheer legal prevision hasn’t been enough to solve it; which brings us to the third chapter. Here, we explore not only the more concrete measures and projects that are currently in place to foster the simplification of the language in multiple legal bodies, but also propose some solutions which are yet to be explored and which, as we see it, could bring beneficial outcomes. |
