Resumo(s): | A grande questão que se coloca e à qual o presente estudo pretende dar resposta diz
respeito à eventual tutela que a ordem jurídica portuguesa consagra aos nascituros,
nomeadamente no que respeita à compensação por danos não patrimoniais próprios
sofridos com a morte de um dos progenitores.
Visa-se, em primeiro lugar, analisar o instituto da responsabilidade civil em geral e
o preenchimento dos seus pressupostos e, posteriormente, entrar na concreta temática da
compensação por danos não patrimoniais, analisando a evolução da sua consagração no
ordenamento jurídico português. Neste contexto, a norma jurídica a analisar que urge
analisar-se é a constante no artigo 496.º do Código Civil, por intermédio da qual se
estabelece a compensação por danos não patrimoniais bem como os beneficiários do
direito à compensação no caso de morte da vítima, consistindo a sua interpretação num
dos elementos centrais da presente dissertação. Nesta sede, analisar-se-á também quais
os danos não patrimoniais que merecem compensação pela ocorrência do dano da morte
e quem são os beneficiários dessa compensação.
A grande tónica é, no entanto, a de saber em que medida é que o nascituro, como
filho da vítima, pode ser considerado como beneficiário do direito à compensação por
danos não patrimoniais próprios sofridos por morte do pai. Ora, a resposta a esta questão
não tem sido unânime, quer na doutrina quer na jurisprudência, com recurso a vários
argumentos de ambas as fações. Não pode, no entanto, a nosso ver, levando sempre em
conta os argumentos apresentados em sentido contrário, tutelar-se juridicamente o filho
já nascido, que sofreu danos não patrimoniais pela morte do seu progenitor, e já não se
tutelar juridicamente a criança ainda não nascida – nascituro - à data da morte do seu
progenitor, mas que sofrerá igualmente danos não patrimoniais, ao longo da sua vida,
pelo facto de jamais poder privar com o seu progenitor. E é justamente essa a posição que
iremos fazer valer na presente dissertação. The big question that arises and which the present study aims to answer concerns the possible protection that Portuguese law dedicated to individuals in unborn condition, particularly with regard to compensation for personal injury suffered themselves because of the death of one parent. In a first stage, we will focus on key questions concerning civil liability and the fulfilment of its assumptions and later we will make a reference to the provisions regarding compensation for personal injury. In this context the study aims to analyse, above all, the evolution of the acclaim of compensation for personal injury in the Portuguese legal system. Following this, the rule of law that prevails to examine is the Article 496.º of the Civil Code, which establishes the compensation for personal injury in our legal system as well as persons entitled to compensation in the case of victim's death, the core of the issues raised along the dissertation. Firstly because it triggers the question of civil liability that emerges from the damage of death, being the case that there are voices that deny and others who claim the right to compensation arising from death damage. And yet, in the midst of those who claim a right to such compensation, there are several current doctrinal and jurisprudence regarding the manner of acquisition of that right. However, a great emphasis is to what extent is that the unborn child, being the son of the victim, can be considered as a beneficiary of the right to compensation for the death of his father. Now the answer to this question has not been at all unanimous, either in doctrine or in case law, using several arguments of both factions. However, it cannot, in our view, taking into account the arguments to the contrary, if legally protect the child already born, he suffered personal injury by the death of his parent, and no longer legally protect the child still unborn the date of death of the parent, but also suffer personal injury, throughout his life, because of ever being able to deprive with its parent. And it is precisely this position that we will enforce in this dissertation. |
