A cooperação das Câmaras Municipais nas Associações de Municípios : o caso do distrito de Braga

Abstract

O presente trabalho enquadra-se no mestrado em Administração Pública e trata-se de um estudo que tem por objecto as duas Associações de Municípios existentes no Distrito de Braga: A Associação de Municípios do Vale do Cavado (AMVC) e a Associação de Municípios do Vale do Ave (AMAVE). Num momento de mudanças e de incertezas no que ao associativismo intermunicipal diz respeito, procurou-se perceber o porquê da existência destas estruturas, quais as motivações que estiveram por detrás da decisão da sua criação, quais as razões dos vários municípios que os impeliram à participação nestas organizações, como funcionam, como se estruturam, que dinâmicas encerram e como perspectivam os participantes a sua participação, bem como, o actual momento no que ao associativismo intermunicipal diz respeito, nomeadamente tentar perceber como encaram a criação das Grandes Áreas Metropolitanas (GAM) e as Comunidades Urbanas (ComUrb). A pergunta de base que presidiu a esta investigação foi tentar saber, em que medida a adesão e a participação dos vários municípios nestas estruturas tem por base um comportamento interessado e oportunista, na medida em que, cada participante pretende com a sua participação nestas organizações resolver problemas com que se depara particularmente, existindo assim, um comportamento auto-interessado de cada actor. No primeiro capítulo do trabalho será realizado o enquadramento teórico e a respectiva análise. Serão analisados os modelos de relações institucionais e interinstitucionais, onde se encontrarão os elementos relativos à nova organização do estado, a caracterização das Networks; os modelos de relações centradas nos actores; os actores e a interacção, factores que influenciam essa interacção; o funcionamento das relações inter organizacionais; a abordagem do neo-institucionalismo; a questão da cooperação da coordenação e da colaboração; a governação; as relações intergovernamentais e a governação; e, finalmente será realizada uma análise crítica às networks. No segundo capítulo será introduzida a temática das Associações de Municípios como modelo de governação; a administração autárquica portuguesa; os factores que motivam os municípios a se associarem; a evolução das formas de associação em Portugal; o contexto do surgimento das associações de municípios em Portugal; o enquadramento jurídico, a estrutura e a organização das associações de municípios; bem como outras formas de associativismo. No terceiro capítulo será enquadrada a metodologia utilizada, os objectivos da análise; a metodologia de investigação; a caracterização dos inquiridos; as dimensões analisadas; a metodologia qualitativa; e, o método do estudo de caso. Nas partes seguintes concretizar-se-ão as conclusões da investigação efectuada quer à Associação de municípios do Vale do Cavado (AMVC), quer à Associação de Municípios do Vale do Ave (AMAVE); surgindo no final um capítulo comparativo entre as duas estruturas, onde se encontrarão as conclusões do trabalho, verificando-se e existência, ou não de corroboração da hipótese proposta para este estudo.

The present work is fit in the master in Public Administration and is a study that has as object the two Associations of Municipalities of the District of Braga: The Association of Municipalities of the Cávado Valley (AMVC) and the Association of Municipalities of the Ave Valley (AMAVE). At a moment of changes and uncertainties in the inter municipal associativism, it was looked to understand the reasons for the existence of these structures, which are the motivations of the decision of its creation, which are the reasons of the municipalities that had impelled them to the participation in these organizations, how they function, how they are structuralized, the dynamic they have, and the participation, as well as the current moment of the inter municipal associativism, to try to understand how they face the creation of Grandes Areas Metropolitans (GAM) and Comunidades Urbanas (ComUrb). The question that presided over this study was to know in which measured the adhesion and the participation of the some municipalities in these structures is a result of an self-interested and opportunist behaviour in the measure that each participant intends, with its participation in these organizations, to deal with its particular problems, existing, therefore, an auto-interested behaviour of each actor. In the first part of the work it will be carried through the theoretical framing and the respective analysis. The models of institutional and inter institutional relations will be analyzed; the new organization of the state, the characterization of the Networks; the models of relations centred in the actors; the actors and the interaction, factors that influence this interaction; the functioning of the Inter organizational relations; the neoinstitutionalism; the question of the cooperation, the coordination and the collaboration; the inter governmental relations and the governance; and, a critical analysis to the networks. In the second part of the work the thematic of the Associations of Municipalities will be introduced as a governance model; the Portuguese autarchic administration; the factors that motivate the municipalities to the association; the evolution of the forms of association in Portugal; the context of the sprouting of Associations of Municipalities in Portugal; the legal framing, the structure and the organization of the those associations; and, other forms of associativism. In the third part the used methodology will be fit, the goals of the analysis; the inquiry methodology; the characterization of the inquired ones; the analyzed dimensions; the qualitative methodology; and, the method of the case study. In the following parts the conclusions of the inquiry will be materialize, appearing in the end a comparative chapter between the two structures, where the conclusions of the work will be, verifying the existence, or not, of corroboration of the hypothesis proposal for this study.
