A marca de prestígio à luz da jurisprudência comunitária

Abstract

Este estudo corresponde à versão escrita da nossa intervenção na IV Conferência Industrial Propriedade [organizada pelo IDIUS e pelo Centro de Estudos e Documentação Europeus da USC (García Vidal, Framiñán Santas e Maroño Gargallo (dirs.)) realizada no dia 26 de outubro de 2012, na Faculdade de Direito da Universidade de Santiago de Compostela. O texto analisa alguns dos aspectos mais relevantes da proteção alargada das marcas de prestígio à luz da jurisprudência comunitária: os requisitos e o âmbito dessa proteção.

This study corresponds to the written version of our intervention on IV Conference of Industrial Property [organized by IDIUS and the Center for European Studies and Documentation of USC (García Vidal, Framiñán Santas y Maroño Gargallo (dirs.))] held on the 26th October 2012, at the Faculty of Law, University of Santiago de Compostela, which we have dedicated to the analysis of some of the most relevant aspects concerning the extended protection of trade marks with reputation in the light of Community case-law: the requirements and scope of that protection.
