Avaliação psicológica forense do abuso sexual de crianças: caracterização - impacto nas decisões judiciais

Abstract

O abuso sexual de crianças é um problema mundial. Este estudo tem como objetivos gerais caracterizar as perícias psicológicas forenses do abuso sexual de crianças, da Unidade de Psicologia da Justiça e Comunitária da Universidade do Minho e verificar o impacto destas nas decisões judiciais. Foram analisadas 53 perícias, correspondentes a 60 crianças avaliadas e 32 decisões, das quais 17 correspondem a julgamentos efetivamente realizados. Para concretizar os objetivos, construíram-se grelhas de análise de conteúdo (através de revisão teórica/análise documental). Posteriormente utilizaram-se estatísticas descritivas (frequências absolutas/relativas). Os resultados revelaram crianças predominantemente do sexo feminino, com uma média de idades de 9,17 anos e comportamentos de internalização, na generalidade. Mais de metade revelou o abuso, possuía competências desenvolvimentais adequadas à idade, capacidade de testemunho, foi alvo de abuso intrafamiliar, menos severo e perpetrado por elementos masculinos. Porém, a credibilidade (quesito mais frequente) só foi obtida em 26 crianças. Os relatórios periciais seguiram o protocolo utilizado na Unidade. Relativamente ao impacto, a concordância entre as perícias e as decisões judiciais e a referência das perícias nestas, estiveram presentes na maioria dos casos. Conclui-se, na senda de estudos anteriores, que existe uma crescente solicitação/valorização das perícias para a tomada de decisão judicial.

Child sexual abuse is a worldwide problem. This study aims to characterize the psychological forensic expertise of child sexual abuse, of the Unit of Psychology of Justice and Community of the University of Minho and verify their impact on judicial decisions. A total of fifty-three expertise were analysed, corresponding to 60 children evaluated and 32 decisions, of which 17 correspond to judgments actually realized. To achieve the objectives, content analysis grids were built up (through literature review/document analysis). Subsequently descriptive statistics were used (absolute/relative frequencies). Results showed children predominantly female, with an average age of 9,17 years and behaviours of internalization in general. More than half revealed the abuse, had developmental skills appropriated to the age, witness capacity, and was target of intra-family abuse, less severe and perpetrated by male elements. However, the credibility (most frequent query) was only obtained in 26 children. The expertise reports followed the protocol used in the Unit. Concerning the impact, the correlation between expertise and the judicial decisions and the reference of the expertise in these, were present in most of the cases. In conclusion, in the path of previous studies, that there is a growing request/valuation of the expertise for the judicial decision-making.
