Resumo(s): | O presente relatório de mestrado, cujo tema é “ A interpretação jurídica do
conceito de prestação de serviços médicos ”tem como intuito tratar e analisar a questão
inserta no n.º 2 do art. 9º, capítulo II, Isenções, Secção 1 Isenções nas operações
internas do CIVA.
A questão fulcral que constituirá o objeto da presente análise pode ser resumida
do modo que segue:
A isenção consignada no n.º 2 do art. 9º do CIVA encerrará em si um conceito
de prestação de serviços médicos, tendentes a concretizar o conceito de saúde que nos é
fornecido pela Organização Mundial de Saúde — como revelador de “um estado de
bem-estar físico, mental ou social completo e não a mera ausência de doença ou
enfermidade”—, ou pelo contrário, o espírito da norma, exclui as prestações de serviços
médicos que embora tendentes a melhorar a saúde do individuo visam uma melhoria do
bem-estar mental, social e físico do indivíduo, por reestruturação de estruturas
defeituosas ou ausentes, ou por modificação da sua textura e/ou configuração em
relação a estruturas contíguas?
A propósito será abordada a problemática da aplicação da norma prevista no nº
2 do artº 9º do CIVA. Será feita também uma análise do conceito de prestação de
serviços médicos e ato médico, dando conta da jurisprudência do Tribunal da Justiça
das Comunidades Europeias (TJUE), tentando contribuir para a clarificação e
densificação dos pressupostos que estão subjacentes a este conceito. This master's report, whose theme is "The legal interpretation of provision of medical services" has the intention to treat and analyze the question inserted in nr. 2 of art. 9, Chapter II Exemptions, Section 1 Exemptions to internal CIVA operations. The key issue that will be the object of this analysis can be summarized as set out below: The exemption as set forth in nr. 2 of art. 9 of CIVA will close itself a concept of provision of medical services, aiming to realize the concept of health to us is provided by the World Health Organization - as revealing "a state of physical, mental or complete social well-being and not merely the absence of disease or infirmity" - or rather, the spirit of the rule, excludes the provision of medical services but to improve the health of the individual aim to improve the mental, social and physical well-being of the individual, for restructuring defective or missing structures, or by modifying the texture and / or configuration with respect to adjacent structures? The purpose will be addressed the issue of the application of the rule provided for in nr. 2 of article 9 of CIVA. It will also be an analysis of the concept of provision of medical services and medical procedures, taking account of the decisions of the Court of Justice of the European Union (CJEU), trying to contribute to the clarification and densification of the assumptions that underlie this concept. |
