External and internal dynamics in the EU's counter-terrorism policy: a political and legal analysis

Abstract

This dissertation focuses on the EU’s counter-terrorism policy. It investigates whether the EU’s constitutional foundations have in impact in the practice of counter-terrorism within the EU. For conducting the inquiry, it employs a double-layered theoretical framework encompassing sociological institutionalism and constitutionalism. It is argued that a full understanding of this complex political object requires the contribution of both political science and legal theoretical tools. In concrete, it is argued that the EU’s counter-terrorism policy is an institution constituted by formal rules, procedures and norms, but also symbols and moral templates. The legitimacy and social appropriateness of this institution is granted by the EU’s constitutional foundations, which therefore impact on the way counter-terrorism is practiced by the EU. A plethora of institutions and agencies develop a multi-level, cross-sectoral counter-terrorism policy that overcomes the internal / external divide. The practice of counter-terrorism at the EU level is influenced by the EU’s constitutional foundations via a four-stage causal mechanism. This causal mechanism is verified in three chronological phases, which are named aprioristic presence, legislative and executive presence, and ulterior supervision. The constitutional nature of the EU forms part of the explanation for the characteristics of the EU’s counter-terrorism policy, to which the political nature of the EU and the characteristics of terrorism as a threat also concur. These dynamics are seen in the internal dimension of the practice of the EU’s counter-terrorism, but interestingly they can also be observed in the external front, more specifically in the EU’s cooperation with its two most important partners in fighting international terrorism: the UN and the US. Each of these cases exhibits different dynamics but both of them denounce the presence and importance of the EU’s constitutional foundations. Using an innovative theoretical framework and putting forward original arguments and new systematic forms of understanding the EU’s counter-terrorism policy, this dissertation contributes to the existing literature and makes a case for the necessity of using combined political and legal approaches to study this important topic.

Esta dissertação centra-se na política antiterrorista da União Europeia (UE). Em concreto, este estudo investiga se as fundações constitucionais da UE influenciam a prática de antiterrorismo no seio da UE. Na condução da investigação, esta dissertação utiliza uma abordagem teórica de dois níveis englobando institucionalismo sociológico e constitucionalismo. Defende-se aqui que um entendimento cabal deste complexo objecto político só é possível com recurso a ferramentas teóricas das tradições da ciência política e do direito. Em concreto, este estudo argumenta que a política antiterrorista da UE é uma instituição (no sentido teórico) constituída por regras formais, procedimentos e normas, mas também por símbolos e esquemas morais. A legitimidade e a adequabilidade social desta instituição são-lhe conferidas pelas fundações constitucionais da UE, que por sua vez têm um impacto na prática de antiterrorismo por parte da UE. Esta consiste em acções desenvolvidas por uma plêiade de actores e agências que implementam uma política multinível, transcendendo a divisão interno/externo e outras divisões sectoriais. A prática de antiterrorismo na UE é influenciada pelas fundações constitucionais da UE através de um mecanismo causal composto de quatro etapas distribuídas por três fases cronologicamente organizadas, às quais aqui se atribui as designações de ‘presença apriorística’, presença executiva e legislativa’, e ‘supervisão ulterior’. A natureza constitucional da UE forma parte da explicação para as características da política antiterrorista da UE, para as quais a natureza política da UE e a as características do terrorismo enquanto ameaça também concorrem. Estas dinâmicas verificam-se na dimensão interna da política antiterrorista da UE, mas também podem ser observadas na sua dimensão externa, nomeadamente na cooperação internacional com as Nações Unidas e os Estados Unidos. Usando um enquadramento teórico inovador e propondo argumentos originais e novas formas sistematizadas de entender esta importante política, esta dissertação contribui para a literatura e constitui um apelo ao uso de abordagens multidisciplinares no estudo de objectos políticos com a complexidade da política antiterrorista da UE.
