dc.description.abstractO presente estudo diz respeito à responsabilidade do produtor pela conformidade do bem. Pretende-se estudar a introdução do conceito de conformidade do bem com o contrato, na venda de bens de consumo, pela Diretiva n.º 1999/44/CE, de 25 de maio, e transposto para o ordenamento jurídico português pelo Decreto-Lei n.º 67/2003, de 8 de abril. A responsabilidade do produtor pela conformidade do bem é também alvo do nosso estudo, pois trata-se de um regime apresentado pela Diretiva apenas como uma possibilidade, mas que o legislador nacional decidiu introduzir no ordenamento jurídico português, indo mais longe que a própria Diretiva. O estudo passa por uma análise de direito comparado dos ordenamentos jurídicos espanhol, francês e alemão, na medida em que a introdução do conceito de conformidade, bem como a consagração do regime da responsabilidade do produtor pela conformidade do bem não foi realizada da mesma forma nos ordenamentos jurídicos em questão. O presente trabalho encontra-se dividido em três partes: Parte I composta por um capítulo, a Parte II e a Parte III composta por três capítulos. Na Parte I é realizado um estudo da Diretiva n.º 1999/44/CE, de 25 de maio, focando o seu âmbito de aplicação, a introdução inovadora do conceito de conformidade do bem com o contrato e a possibilidade de consagrar um regime de responsabilidade direta do produtor pela conformidade do bem. A Parte II diz respeito à transposição da Diretiva para o ordenamento jurídico português, restringindo o estudo ao método de transposição adotado pelo legislador nacional, bem como a forma de transposição do conceito de conformidade e a inovadora consagração do regime de responsabilidade do produtor pela conformidade do bem. Na parte III é realizado um estudo comparado dos ordenamentos jurídicos espanhol, francês e alemão, realçando os diferentes métodos de transposição da Diretiva, nomeadamente no que diz respeito à conformidade do bem com o contrato e à responsabilidade do produtor pela conformidade do bem. Concluímos o presente estudo com uma ponderação sobre a tão desejada harmonia e unidade do sistema jurídico nacional e europeu, nomeadamente no que diz respeito ao direito dos contratos.por
dc.description.abstractThis study concerns the producer’s responsibility for the conformity of the good. We intend to study the introduction of the concept of the conformity of the good with the contract in the selling of consumer good by the Directive n.º 1999/44/CE, 25th May, transposed to the Portuguese Law by the Decree-Law n.º 67/2003, 8th April. The producer’s responsibility for the conformity of the goods is also under our study because it is a system presented by the Directive only as a possibility, but the national legislator decided to introduce it in the Portuguese Law which goes further than the Directive itself. The study is an analysis of compared Law once the introduction of the conformity’s concept, as well as the consecration of the liability system of the producer for the conformity of the good wasn’t out in the same way in the Spanish, French and German Law. This study is divided into three parts: Part I, made up of one chapter; Part II and Part III made up of three chapters. In Part I is developed a study of the Directive n.º 1999/44/CE, 25th May, which focuses its range of enforcement in the innovative introduction of the concept of the conformity of the good with the contract and the possibility of consecrating a system of the responsibility of the producer for the conformity of the good. Part II concerns the Directive’s transposition to the Portuguese Law, limiting the study to the transposition method adopted by the national legislator, as well as the way the conformity’s concept is transposed and the innovative consecration of the system of the producer’s responsibility for the conformity of the good. In Part III is developed a study that compares the Spanish, French and German’s Law emphasizing the different methods of the Directive’s transposition, namely concerning the conformity of the good with the contract and the producer’s responsibility for the conformity of the good. This study ends with the reflection about the so desired harmony and unity of the national and European’s Law namely in what concerns the contract Law.por
