Representações e expectativas de mães e pais intervenientes em investigações de paternidade

Abstract

À semelhança do que acontece em vários países, no que respeita a políticas de protecção dos direitos das crianças, em Portugal, o Estado desencadeia uma investigação de paternidade sempre que é registada uma criança nascida fora do casamento sem que conste a identificação do pai. Nestas situações, é frequente que os tribunais utilizem testes genéticos para apuramento da paternidade biológica. Esta investigação incide sobre esta realidade, nomeadamente, sobre as percepções que mães e pais, envolvidos em investigações de paternidade, desenvolvem acerca da actuação da justiça neste âmbito. Colocando a ênfase na questão da parentalidade, o objectivo principal deste estudo é captar as expectativas que os pais revelam quanto à relação parental que pretendem desenvolver com os respectivos filhos. Através da análise dos testemunhos das mães e dos pais, que foram entrevistados após o conhecimento da “verdade biológica”, tenta-se perceber até que ponto estes actores sociais valorizam os laços biológicos e que importância atribuem aos laços afectivos, numa relação de pai e filho. A presente tese tem como propósito aferir se os pais e mães envolvidos em acções de investigação de paternidade alimentam a crença que à certeza da paternidade, proporcionada pela tecnologia de DNA, segue-se a edificação de uma paternidade efectiva, materializada nas práticas do dia-a-dia.

As happens in several countries, regarding to policies to protect the rights of children, in Portugal, the State triggers a paternity investigation whenever a child is registered without the father’s identification. Usually, in these situations the courts utilize genetic tests to inquiry of the biologic paternity. This investigation focuses on this reality, namely, on the perceptions that mothers and fathers, involved in paternity investigations, develop about the justice intervention on this ambit. Taking in consideration the parenting question, the main goal of this study is to collect the expectations that parents reveal in what respect to the parental relationship that they want to develop with the respective children. Through the analysis of parents’ testimonials, who were interviewed after the knowledge of the “biological truth”, I try to understand how these social actors value the biological ties and what importance they give to affective ties, in a relation between father and his child. This thesis pretends to assess if the fathers and mothers involved in paternity investigations have the belief that the paternity certainty provided by DNA technology will lead to edification of an effective paternity, materialized on day to day care.
